Waiver:
By attending "Tuesday Night
Hockey" you enter into an agreement with Jon Balvance, separate entity from the
Saint Thomas Ice Arena.
Jon Balvance agree’s to
allow you to play and / or watch ice hockey and ice skating at a time and
location which I have leased or otherwise acquired the rights to. In
consideration of allowing you to play or watch ice hockey or ice skating, you
agree to pay Jon Balvance a reasonable sum of money to be determined solely by
Jon Balvance.
Further, you agree to defend, indemnify and hold Jon Balvance harmless from any
and all claims, liabilities, judgements, losses, damages, criminal charges,
costs and expenses (including attorney's and other legal fees) asserted
against Jon Balvance by any person or entity, or incurred by Jon Balvance,
arising out of any injury, illness, death, property or other loss or damage
arising out of playing and/or watching ice hockey or ice skating. You
understand that playing or watching ice hockey or ice skating is inherently
dangerous. You understand that a person could be seriously injured, paralyzed,
or killed while playing or watching ice hockey or ice skating, and you agree
to assume all those risks in consideration of Jon Balvance entering into this
agreement with you. You certify that you are a legal adult and are competent
to enter into this agreement. You understand that this agreement is in
effect during all times you watch or play ice hockey or ice skating at a time
and location leased or otherwise acquired by Jon Balvance.
Lastly, you understand that as a condition of this agreement, Jon Balvance
require you to wear a protective equipment consisting of, at a minimum, an
approved helmet, and shin/knee pads. Also, you understand that wearing
protective equipment, such as approved helmets, face shields, and other such
equipment significantly lowers the probability of injury and death, and you
fully understand that Jon Balvance strongly recommends or require its use.
